1) Terms of Use
Agreement. By using the website, forms, and phone numbers of Clever Home Solution (the “Service”), you accept these Terms. Age 18+ only.
Who we are / Not a brokerage. We are a real estate development company and potential direct buyer. We are not your agent or broker and do not provide legal or tax advice.
Not an offer. Any “instant”/“cash” estimates are invitations to negotiate — not binding offers. Any deal depends on due diligence (inspection, title, valuation) and a signed purchase agreement.
E‑Sign & electronic communications. You agree to receive electronic communications (email, SMS) and to use electronic signatures/records. You may withdraw e‑signature consent via the contact methods below; withdrawal may limit our ability to provide the Service.
Call/text recording. Calls and texts may be recorded/stored for quality, compliance, and record‑keeping (with notice/consent where required).
IP & acceptable use. Site content is ours/licensors’. No copying/scraping beyond personal, non‑commercial use or standard search protocols. No fraud, spam, automated form submissions, security circumvention, malware, or rights violations.
Third‑party tools. We use third‑party maps, analytics, advertising, and chat tools. Their policies apply to those tools.

2) Calls & SMS (Compliance Essentials)
What you’ll receive. Recurring calls/texts about your inquiry, appointments, and property offers. Message frequency varies.
Consent. When you submit your number or text our keyword, you give prior express written consent to marketing calls/texts; autodialer/prerecorded tech may be used. Consent is not required to buy/sell property.
Opt‑out & help. Reply STOP to cancel (we’ll confirm). Reply HELP for help. You can also email getcleversolution@gmail.com.
Rates & carriers. Message & data rates may apply. Carriers are not liable for delayed/undelivered messages.
Eligibility. You are 18+ and the subscriber/customary user of the number you provide.
Quiet hours & DNC. We do not call before 8:00 a.m. or after 9:00 p.m. local time and maintain an internal Do‑Not‑Call list. We use the FCC Reassigned Numbers Database to reduce misdirected calls/texts.
Recordkeeping. We retain consent records, scripts, and opt‑outs for at least 24 months.

3) Privacy (Short Notice at Collection)
What we collect:
* Identifiers/Contact: name, email, phone, IP.
* Property/Transaction: address, details/photos you provide, offer/closing info.
* Internet/Usage: pages viewed, UTM, cookies/pixels, approximate geolocation from IP.
* Communications: call recordings and text logs (with notice/consent where required).
* Inferences: interest/likelihood to sell.
* Sensitive data: not sought via the Site except if needed for a transaction (e.g., ID for title/escrow), used minimally per law.
Sources. You, cookies/tags, advertising & analytics partners, public records, service providers.
Purposes. Evaluate your submission and make/update offers; communicate about your inquiry; marketing/remarketing & analytics; security and legal compliance.
Disclosures. To service providers (hosting, CRM, analytics, communications, title/escrow), advertising/analytics partners (which may be deemed “sale”/“sharing” under some state laws), business transferees, and legal authorities.
Retention. Leads up to 3 years; transactions 7 years; analytics up to 26 months (longer if legally required).

6) Privacy Details (Optional Depth)
Legal bases: consent (marketing), contract (handling your submission/transaction), legitimate interests (analytics/security), and legal obligations. We do not target EEA/UK; if we do, we will implement required safeguards (e.g., SCCs/representatives) and local rights.
7) Liability & Disputes
No warranties. Service is provided “as is/as available.”
Liability cap. To the fullest extent allowed, our total liability is limited to $100 or what you paid us in the past 12 months, whichever is greater.
Indemnity. You will defend/indemnify us for violations of these Terms or misuse of the Service.
Arbitration & class‑action waiver. Except small‑claims and IP/injunctions, disputes go to binding AAA arbitration (Consumer Rules), individual only (no class/representative actions). Opt out within 30 days of first acceptance by written notice to the address below.
Governing law & venue. Laws of Wyoming (no conflict rules). Courts in Sheridan, WY have exclusive jurisdiction where court relief is needed.
